Please read these Terms of Use carefully before using the Website.

These terms of use are entered into by and between you and Stability Solutions, Inc. (“Stability”, “we”, or “us”). 

These terms, together with any documents incorporated by reference (collectively, the “Terms of Use”), govern your access to and use of any webpage published by Stability, including, but not limited to, any content, functionality, or services offered on or through the following domains (collectively, the “Website”):

    • trade sanctions regimes;
    • provision of regulated payment services;
    • securities, futures, and commodities;
    • intellectual property;
    • gaming and gambling;
    • personal data protection and data privacy;
  • impersonate or attempt to impersonate Stability, its employees, or any other person or entity, or imply any affiliation with the foregoing where such affiliation does not exist;
  • send, knowingly receive, upload, download, use, or re-use any material which does not comply with these Terms of Use;
  • harm others or commit any crime, including:
    • exploiting, abusing, or otherwise harming others, such as promoting discrimination, bigotry, racism, harassment, harm, violence or threats of violence against any individual or group, facilitate human trafficking, incite hatred, etc;
    • exploiting, abusing, violating the individual rights of, or otherwise harming minors in any way, including exposing minors to violence, pornography, or otherwise inappropriate content, obtaining personal data of minors without the consent of their parents or legal guardians, and other actions resulting in harm to minors whether online or offline and regardless of whether the harm is physical or mental;
  • infringe on the legal rights of others, including:
    • infringing on Stability’s intellectual property rights or third-party intellectual property rights;
    • infringing on the data protection and privacy rights of others;
  • interfere with the Website, including:
    • doing anything (including using any device, software, or routine) to disable, overburden, damage, or impair the Website, or interfere with, restrict, or inhibit anyone's use or enjoyment of the Website or their ability to engage in real time activities through the Website;
    • doing anything which, as determined by us, may harm Stability or users of the Website, or expose them to liability;
    • introducing any viruses, trojan horses, worms, logic bombs, or other material which is malicious or technologically harmful;

Stability’s name, logo, trade names, product names, service names, devices, and all related marks, are trademarks of Stability or its affiliates or licensors. You must not use such marks without Stability’s prior written consent. All other names, logos, trade names, product names, service names, devices, and related marks on this Website are the trademarks of their respective owners. If you wish to use their marks, you should contact them directly to request permission.

Links to the Website

You may link to the Website provided you do so in a way that is fair, legal, and does not damage our reputation or take advantage of it. You must not suggest or represent any form of association with Stability, or any approval or endorsement by us, without our express prior written consent. We reserve the right to withdraw linking permission without notice.

Any links from the Website to third party websites or resources (including banner advertisements) are provided solely for your convenience. We have no control over the contents of third party websites or resources, and accept no responsibility for them or for any loss or damage that may arise from your use of them. Disclaimer of warranties

Stability does not guarantee or warrant that files that you download from the internet or the Website are virus-free or free of harmful code or functionality. The internet is not an inherently secure environment and you are responsible for implementing the necessary security measures to ensure your environment remains virus-free and to back up your data.

Indemnification

You agree to defend, indemnify, and hold harmless the Protected Parties from and against any claims, demands, lawsuits, actions, proceedings, investigations, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or in connection with any breach of these Terms of Use or your use of the Website, including but not limited to using the Website and its contents, goods, or services in a manner or for a purpose other than as expressly authorized in these Terms of Use or as described in documentation relating to the relevant goods or services. In the event your obligation to indemnify any Protected Party arises, we (or the applicable Protected Party) shall have the right in our sole and unfettered discretion to control any action, proceeding, settlement, and terms of settlement if any, as the case may be.

Changes to the Terms of Use

We may revise and update these Terms of Use from time to time at our sole and unfettered discretion. All changes shall take effect immediately upon being published.

Your continued use of the Website following the posting of revised Terms of Use means that you accept and agree to the changes. You are expected to check this page regularly so you are aware of any changes, as they are binding on you.

Governing law and jurisdiction

All matters relating to the Website and these Terms of Use and any dispute or claim arising therefrom or related thereto (in each case, including non-contractual disputes or claims), shall be governed by and construed in accordance with the laws of the State of Nevada without giving effect to any choice or conflict of law provision or rule (whether of Nevada or any other jurisdiction).

The parties submit to the exclusive jurisdiction of the courts of the State of Nevada, United States of America, in full and final resolution of any dispute arising out of or in connection with these Terms of Use or the Website. Notwithstanding the foregoing, we retain the right to bring any action or proceeding against you for breach of these Terms of Use in your country of residence or any other relevant country. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.

No waiver

No waiver by Stability of any term or condition set forth in these Terms of Use shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition.

No failure of Stability to assert a right or provision under these Terms of Use shall constitute a waiver of such right or provision.

Severability

If any provision of these Terms of Use is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such invalid, illegal, or unenforceable term or provision shall be deemed not to be part of these Terms of Use and the remaining provisions of the Terms of Use shall not be affected by such invalidity, illegality, or unenforceability and shall continue in full force and effect.

Entire Agreement

The Terms of Use and our Privacy Statement constitute the entire agreement and understanding between you and Stability relating to the Website and supersede all prior and contemporaneous agreements and understandings including representations and warranties, whether express, implied, written, or oral, with respect to the Website.
